The Constitution is the highest law in Ghana. All security agencies that have the power to arrest people must follow it.
These agencies include the Ghana Police Service, Bureau of National Investigations, Economic and Organised Crime Office, Office of the Special Prosecutor, National Security, and Ghana Immigration Service.
They are all created by laws that must respect the Constitution.
Therefore, these institutions must work within the rules set by the Constitution.
Article 14 subsection 2 of the 1992 Constitution clearly states the rights of arrested persons.
This includes the right to speak with a lawyer or a legal representative.
Denying suspects access to legal counsel is a violation of their fundamental human rights.
Security agencies must stop this practice and ensure all constitutional rights are respected during arrests and detentions.
