Lawyers for former Finance Minister Ken Ofori-Atta used videos of protests outside the US Embassy in Accra to argue that he would be in danger and denied a fair trial if deported to Ghana.

Ghana's Ambassador to the United States, Victor Smith, disclosed this in a television interview on 2 November 2026. The protesters had demanded Mr Ofori-Atta's return to Ghana.

Mr Smith said the immigration case, in which Mr Ofori-Atta has been granted a stay of deportation, is separate from Ghana's extradition request, which is being handled by the US Department of Justice. Mr Ofori-Atta is presumed innocent of the allegations he faces in Ghana.

Attorney-General Dr Dominic Ayine and officials of the Economic and Organised Crime Office travelled to the US for meetings on the extradition request. Mr Smith said it was too early to say whether a strong enough case had been built, but that the government is still pursuing extradition.
