The Accra High Court has adjourned the US$2 million SkyTrain trial to Monday, 19 October 2026, after counsel for the first accused, former Ghana Infrastructure Investment Fund (GIIF) Chief Executive Officer Solomon Asamoah, asked the court to allow the Supreme Court to rule on his application seeking to halt the trial.
Mr Asamoah and former GIIF Board Chairman Prof. Christopher Ameyaw-Akumfi are standing trial for allegedly causing a US$2 million financial loss to the state by investing the money in the SkyTrain project, Daily Guide reports.
The court, presided over by Justice Audrey Kocuvie-Tay, had set aside 5 to 7 October 2026 for a case management conference, which was expected to pave the way for the accused persons to open their defence after the prosecution closed its case, according to Graphic Online.
At the sitting on Monday, 5 October, counsel for Mr Asamoah, Victoria Barth, told the court that her client had invoked the supervisory jurisdiction of the Supreme Court. She said the application seeks orders of certiorari and prohibition, including an order restraining the High Court from further hearing, continuing with or determining the case.
She said the return date for the application is Tuesday, 13 October 2026, and that any further step in the trial before then could compromise it.
"We are praying the court to take into consideration the fact that the return date for the prohibition application is Tuesday, October 13, and therefore to kindly indulge us a short adjournment for the Supreme Court to hear us," she said, as quoted by Graphic Online and Daily Guide.
Ms Barth told the court that although the Supreme Court had refused Mr Asamoah's earlier application for an interlocutory injunction to halt the trial, her client had shown good faith by filing his witness statement on 23 September 2026. Starr FM reports that the defence also filed 14 subpoenas on 2 October for persons it intends to cross-examine.
The prosecution reminded the court that processes filed at the Supreme Court do not stay proceedings in the High Court, but left the decision on an adjournment to the court, Starr FM reports.
After hearing counsel for the accused persons and the prosecution, the court adjourned the case to 19 October 2026 at 10am.
Neither accused person has been convicted of any offence.
