The High Court in Accra has dismissed an application by former National Signals Bureau boss Kwabena Adu-Boahene and his wife, Angela Adjei Boateng, to strike out portions of the prosecution's written submissions.
According to Citi Newsroom, the submissions were filed on 9 October 2026 in opposition to the accused persons' submission of no case in Republic v Adu-Boahene & 2 Others.
Defence counsel Samuel Atta Akyea argued that the prosecution had attributed statements to witnesses who had not made them and relied on evidence that did not exist on the record.
Deputy Attorney-General Dr Justice Srem-Sai opposed the motion, arguing that the court had no general jurisdiction to expunge parts of a lawyer's written address and describing the application as an attempt to delay proceedings.
The court held that it was not its duty to investigate whether counsel's written submissions accurately reflected the evidence. It said it would decide the case only on evidence properly led and exhibits duly admitted.
The court noted that the defence had already filed a reply to the prosecution's submissions.
The accused persons are presumed innocent, and the court has yet to rule on the submission of no case.
