The Supreme Court of Ghana has set aside a High Court judgment that annulled the parliamentary election results for the 2024 Kpandai Constituency and has restored Matthew Nyindam as the duly elected Member of Parliament for the area.

The Supreme Court’s decision was delivered on Wednesday, January 28, 2026, after hearing an appeal filed by Mr Nyindam challenging the November 24, 2025 ruling of the High Court in Tamale, Commercial Division. The High Court had previously nullified the election results and directed a rerun within 30 days, concluding that the election had been irregular. This decision interrupted preparations by the Electoral Commission to conduct a scheduled by-election.

In the Supreme Court proceedings, the appellant’s counsel argued that the High Court erred in assuming jurisdiction over the matter. Lawyers for Mr Nyindam contended that the petition filed by the opposing candidate, Daniel Nsala Wakpal, did not properly invoke the High Court’s authority under the relevant laws governing parliamentary election petitions. They argued that procedural and substantive rules were not met for the High Court to adjudicate the case as it had done.

After evaluating submissions from both sides, the Supreme Court agreed with Mr Nyindam’s legal team. The Court concluded that the High Court’s assumption of jurisdiction was misplaced and that the earlier judgment could not stand. As a result, the apex court quashed the annulment, effectively reinstating Mr Nyindam’s election victory.

The decision has immediate political implications for the Kpandai Constituency and restores Mr Nyindam’s status as a sitting member of the country’s Parliament. It also halts the electoral commission’s earlier preparations for a re-run of the election that had been ordered by the lower court.

At the time of reporting, neither Mr Nyindam nor his legal team had issued a public comment on the judgment. The candidate whose petition triggered the High Court’s initial ruling, Mr Wakpal, has not yet indicated whether he will pursue any further legal or political action.
