Freddie Blay, the former National Chairman of the New Patriotic Party, is challenging his remand.
He was ordered to be held in police custody following a land dispute at Kitase.
Mr Blay's legal team is taking action to overturn the court's decision.
They plan to file an appeal at the Koforidua High Court.
The court filing is expected on March 17.
